Terms of Service

1. Agreement Overview
By using Inbluum's services, the Client ("Client") agrees to these Terms of Service ("Terms"). Inbluum Inc. LLC, an established company registered in the United Arab Emirates ("Inbluum"), provides services subject to these Terms. Non-compliance with these Terms may result in immediate suspension or termination of services, excluding any ongoing obligations such as payments for services already provided.


2. Service Plans
Inbluum offers monthly design service subscription plans, details of which are available on our website and listed below. These plans may be updated at Inbluum's discretion, so we recommend that clients review the terms regularly. Clients will be charged the fixed fee outlined on the plan on a monthly basis, regardless of whether or not they actively use the service. It is the Client’s responsibility to provide design requests for Inbluum to fulfil. Failure to submit requests does not entitle the Client to a refund or credit. Clients have the right to pause their subscription at anytime.

Website Suite - $5,999 per month (Minimum 4 month subscription term):

3. UX Audit
The Inbluum UX Audit is a one-time service providing a comprehensive review and analysis of your website or app's user experience. The audit includes:• Full UX/UI review & analysis by a certified Baymard eCommerce UX Practitioner (available in both English and Arabic).

• Detailed report of findings, including best practices for each page.
• Suggested improvements, prioritised based on their impact on user experience.
• A conference call to walk through audit findings and recommendations.
• Two follow-up calls or emails to discuss tweaks, redesigns, and address any questions.

Timeline:
Website UX Audit: 14-21 working days.
App UX Audit: 10-14 working days.

Client Responsibilities:
Clients must provide the URL of the website or the app store link for the app to be audited. Inbluum will only audit what is live on the website or app at the time of the audit request.

Standalone Service:
The UX Audit is a one-time, standalone service with a one-off fee, or it can be included as part of the UX/UI Enhance plan.


4. Meeting Policy
At Inbluum, we believe in focusing our time and energy on delivering high-quality design work for our clients. To maximise productivity, we aim to avoid meetings unless absolutely necessary. Instead, we prefer to communicate efficiently through Trello, Figma, and email. Meetings will only be scheduled as a last resort when a detailed discussion is required to move forward.


5. Payment Terms
Inbluum uses Stripe as its trusted partner to process all payments securely with a credit or debit card. We unfortunately do not accept cheques or bank transfers.


6. Pausing Policy
Clients have the right to pause their subscription at any time. To pause and resume the service at a later date, please email info@inbluum.com. Pausing is only allowed once any active work stream has been completed. Any remaining days in the current billing cycle at the time of pausing will be saved and carried over when the service resumes, ensuring no lost time. We will send an email to confirm the pause of your service.


7. Cancellation & Renewal
To cancel your subscription, please provide written notice at least seven days before the next billing cycle to avoid charges for the upcoming period. This helps us manage and reallocate resources efficiently. Refund eligibility and conditions are at Inbluum's discretion. Refunds requested within the first month of service may result in all produced materials reverting to Inbluum's ownership. Upon cancellation, your Trello board and related data will be permanently deleted.


8. Scope of Services
Inbluum offers a comprehensive range of strategic digital design services to enhance your brand and drive business growth. Our expertise includes, but is not limited to: UX audits, website design, mobile app design, landing page design, UX/UI design, website banners, design systems, social media graphics, email design, logos & branding, iconography, illustration, vector graphics, infographics, image editing, mockups, and more.

While we cover a broad spectrum of design needs, there are certain specialised services that we do not provide: 3D modeling, video graphics and editing, document design (e.g., medical forms), complex packaging, and extensive print design (e.g., magazines, books).


9. Acceptance of Work
Clients have a three-day review period after delivery to provide feedback. If no feedback is given within this period, the work will be considered accepted. Further iterations are possible but may impact project timelines.


10. Refund Policy
Inbluum operates on a no-refund policy once services have commenced. Refunds may only be considered at Inbluum’s discretion in exceptional cases, such as failure to provide agreed-upon services. In such cases, refunds will be subject to a review of work completed and must be approved in writing by Inbluum.


11. Intellectual Property Rights
Ownership of all work created for the Client during a paid service period transfers to the Client upon commencement of service. Inbluum retains rights to its foundational content.


12. Ownership of Materials
Final project works become the Client's property upon full payment, excluding Inbluum’s underlying tools and pre-existing materials.


13. Communication
• To ensure we provide the best service to all our clients, we streamline our communication through Trello and Figma.

• Meetings are kept to a minimum to focus on delivering high-quality work. However, for the 'Website Suite' plan, occasional meetings may be necessary to discuss broader project aspects beyond design.

• Our '15-min intro call' is exclusively for potential clients interested in learning more about our design services, UX Audit and to answer any questions etc.


14. Client Responsibilities
Clients agree to use Inbluum's services lawfully and in accordance with these terms. Any illegal or unauthorised use is strictly prohibited.

It is the Client’s responsibility to provide design requests for Inbluum to fulfil. Failure to submit requests does not entitle the Client to a refund or credit. Clients can pause or cancel the service at any time using the agreed-upon method (via Trello card).


15. Prohibited Activities
Clients must not engage in activities that infringe intellectual property rights, are illegal, fraudulent, or violate any third party's rights.


16. Feedback
Clients are entitled to an unlimited number of revisions. Feedback should be communicated through designated channels (Figma, Loom, Trello) to ensure proper documentation and response. Each revision request will be treated as a new request and subject to the standard turnaround time.


17. Modifications to Terms
Inbluum reserves the right to modify these terms at any time. Continued use of our service constitutes acceptance of the new terms.


18. Pricing Update Policy
Inbluum may update its service plan pricing for new clients. However, with our grandfather pricing model, existing clients will retain their current rates as long as they maintain an active subscription. Should a client cancel their subscription and later choose to resume, they will be subject to the current pricing at that time. Pricing updates will only be communicated if clients choose to change their service plan or subscription.


19. Governing Law
These terms are governed by the laws of the United Arab Emirates, where Inbluum is established, without regard to conflict of law principles.


20. Limitation of Liability & Indemnification
Inbluum’s total liability for any claim arising from its services is limited to the amount paid by the Client in the three months preceding the claim. Inbluum is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Clients agree to indemnify Inbluum against any claims arising from their use of our services.


21. Showcasing Work
Inbluum reserves the right to showcase any client work on our website and social media channels, unless restricted by a Non-Disclosure Agreement (NDA).


22. Force Majeure
Inbluum shall not be liable for any delay or failure to perform its obligations under this Agreement if such delay or failure results from events beyond its reasonable control, including but not limited to natural disasters, war, pandemics, strikes, government actions, or other unforeseen events. The affected party must promptly notify the other party of the Force Majeure event and make reasonable efforts to mitigate its effects and resume performance as soon as possible.


23. Dispute Resolution
In the unlikely event of a dispute between Inbluum and the Client regarding services provided, both parties agree to first attempt to resolve the matter through good faith negotiations. If the dispute cannot be resolved through direct discussions, it shall be submitted to binding arbitration in accordance with the rules of the Dubai International Arbitration Centre (DIAC). Each party will be responsible for its own costs associated with the arbitration, and the decision of the arbitrator shall be final and binding. This process does not affect either party’s right to seek immediate injunctive relief where applicable.


24. Confidentiality
Both Inbluum and the Client agree to maintain the confidentiality of all proprietary information, business secrets, and personal data shared during the provision of services. This includes, but is not limited to, designs, workflows, user data, and any non-public information. Confidential information must not be disclosed to third parties without prior written consent, except where legally required.


25. Termination
Either party may terminate this Agreement in line with the cancellation policy. Inbluum reserves the right to terminate services for breaches such as non-payment or violation of terms.

Upon termination by either party in accordance with this Agreement, all outstanding payments must be settled by the Client for work completed up to the termination date. Inbluum will cease all services immediately upon termination. Any files, materials, or other deliverables created up to that point will be handed over once payment is received in full. The Client’s access to the Trello board and other shared platforms will also be removed upon termination.
